Waitangi Treaty Claims Update: Monday 17th March

As you may be aware the Crown has recently accepted the Tuhoronuku mandate to negotiate the settlement of Ngapuhi’s Historical Treaty claims.

It has been a long journey which our hapū and many others around Ngapuhi have opposed.  As a result of these challenges a number of improvements have been made to the mandate;

  • We have increased number of Hapū seats to over double (from 7 to 15). Hapū have the majority decision making power holding 15 of the 22 seats on the Tuhoronuku Independent Mandated Authority (IMA).
  • We have succeeded in getting regionalised Hapū representation so that hapū within each region can work collectively where appropriate and have their representatives be directly accountable back to their own people and claimants.
  • We have made the Tuhoronuku structure independent of Te Runanga Iwi o Ngapuhi.
  • We have ensured 21 of the 22 new trustees on the new body will be elected by a transparent election process run independently of existing Tuhoronuku members and the Runanga.
  • We have ensured Waitangi Tribunal hearing process can continue with the Minister agreeing that the Tribunals jurisdiction will not be affected by any settlement of the claims before the tribunal report is released. So claimants will still be heard and their claims reported on.
  • We have ensured funding of the Waitangi Tribunal hearing process will continue.
  • And we have achieved a conditional mandate with one of the key conditions being:
  1. The Terms of Negotiation about how the Tuhoronuku IMA will work now includes the claimant community in the negotiation and design of the redress package (which will need to recognise specific hapū interests in cultural and commercial redress)
Further the Tuhoronuku Independent Mandated Authority is now required to engage with Ngapuhi on the Post Settlement Governance Entity options from a very early stage. This will ensure there is robust discussions with all of Ngapuhi on the shape of the future Iwi governance and future management of assets.

This means that all hapū can be directly involved, if they choose to be, in the settlement of hapū claims, and in how that redress is managed post settlement, which is far more favourable and positive than what was previously envisaged by Tuhoronuku in the beginning.

On this basis many Hapū who had previously opposed Tuhoronuku are now engaging in the Tuhoronuku process on the condition that all the above expectations are met and that they can and will withdraw in the future if the process is found to be wanting and the guarantees that have been made are not upheld. Further issues still unresolved could potentially be best dealt with at the Tuhoronuku table.

We have also been talking with other Ngapuhi hapū claimants who are putting forward hapū kaikorero and who wish to participate in the negotiations and settlement of Ngapuhi claims. They are keen to work cooperatively with the other hapū of Ngapuhi based on a series of principles which affirm local Mana Whenua throughout the process.

In considering these significant achievements and the agreements that have been secured with the Crown and participating Ngapuhi hapū, and given that the nominations for hapū kaikorero close on the 17th April, the following people have been nominated by our hapu claims collective as potential hapū kōrero; Cheryl Turner for Te Pouka (Nominated by Hone Taimona), John Klaricich for Ngati Wharara (Nominated by Pote Naera), Piripi Moore for Ngati Korokoro (Nominated by Whetu Naera and Fraser Toi)

The Tuhoronuku election process allows for more than one kaikorero to be nominated for each hapū. If more than one nomination is received, a hapū hui will be called to help elect our hapu spokesperson. Hapū members are also able to vote on this representation through a postal ballot and online if they are unable to attend the hapū hui. Should only one person be nominated, they will automatically be elected as the hapū kaikorero. Following the Waitangi Tribunal Hearings a hapu hui will be called at Pakanae to advance our hapū position within the Hokianga hapū collective involved in the settlement process.

We are acutely aware that some concerns still linger about the Tuhoronuku mandate. However given the significant changes that we have been able to effect to the mandate over the past three years, and the collective and cooperative approach been pursued by the other hapū claimants putting forward their kaikōrero, we believe that a pathway to settlement can now be achieved that will meet the aspirations of our hapū in Hokianga and Ngapuhi whānui, and that it is in the best interests of our people to progress at this point and support the mandate to move forward.

Hokianga Waitangi Tribunal Hearing

In the week 6 - 11 April 2014 the Waitangi Tribunal sat at Moria Marae in Whirinaki to listen to our grievances in regards to Crown breaches of Te Tiriti o Waitangi.

Te Hikutu, Ngatihau, Ngati Kaharau and Te Wahapū presented evidence to support hapu claims which was well presented and delivered.

The following submissions were provided by our kaikorero from Te Wahapū for our Ngāti Korokoro, Ngāti Whārārā and Te Poukā historical Te Tiriti o Waitangi claims.
